(Probate is a legal process that takes place after a death) If there is a will then there will be executors and it is their job to administer the estate according to the deceased persons wishes.If there is no will, then a different procedure needs to follow. The dichotomy occurs where inheritance tax or other expenses are levied on the estate. In essence probate will only be granted after the expenses and the inheritance tax are paid. This is usually 6 months after a death. The dilemma arises where the executors are unable to pay the taxes or settle the estate debts. This is where we come in.
