Consent can be express or inferred, but it must be clear and specific. Express consent is obtained when a recipient actively agrees to receive marketing messages; 3.Identification: Marketers must clearly identify themselves and provide accurate contact information in every commercial electronic message sent. 4.Unsubscribe Option: Every commercial email must include a functional unsubscribe mechanism that allows recipients to opt out of receiving future messages. Once a recipient opts out, marketers must honor the request promptly, usually within 5 business days. 5.Content Requirements: Email messages must contain accurate and truthful information about the products or services being promoted. Deceptive or misleading content is prohibited. 6.Transactional Messages: Transactional or relationship messages, which provide information about a transaction or ongoing relationship, are exempt from some of the consent and unsubscribe requirements.
