Im hoping someone can offer some advice on what the Spanish consumer rights are?
I just purchased a 3 months gym membership last week. I was told during the purchase process this was the cheapest offer they could provide. 3 days later I decided to cancel my membership as the equipment they had in the gum was broken and the showers were running cold and just dribble out water. I also found out after purchase there was a 1 month option far cheaper than what I was sold. So it seems there has been some malpractice on their end I was definitely miss-led on price.
After only 3 days of my membership I contacted the gym to cancel my membership but they refuses to give me a refund. What does the Spanish law dictate in this situation?
The response fro the gym has been “The right of cancellation with devolution that you are commenting on does not refer to your type of enrolling but is applicable to enrolling at a distance and outside the commercial establishment. You contracted the services of DiR in person, so your registration in DiR is not subject to the legal right of cancellation with devolution.” This may, or may not be true for a gym, but Im hoping someone knows the answer to that.
Im looking for support from someone who has an understanding of Spanish consumer rights, who can offer some quick feedback, so I have something concrete to go back to the gym chain with.
